Section Six

Qualifications for Permit

Each state law contains a list of qualifications the applicant must meet. Each state also requires that the applicant must not have disqualifying information such as convictions for crimes. Qualifications and disqualifying information were listed and compared to the various state laws. Some prohibitions are absolute while others have limited effective times or allow for discretion in application by the issuing authority.

Points will be awarded as follows:

The differences in criminal offenses that could preclude issuance of a permit varied greatly from state to state. Some statutes presented a relatively long list of criminal offenses. Other states put up a general statement based on a crimes designated punishment.

For the purposes of this study, if the detailed list of crimes fell into one of the general categories, if was lumped into that category. As an example, if the statute list armed robbery and car-jacking as separate disqualifying crimes but the state considered both of these to be felonies, the crimes were lumped into the felony category.

Included in the qualifications listed is the age requirement for a permit and if there are other qualifications a permit applicant must meet such as, being a U.S. citizen.

NOTE: Federal laws governing the possession of weapons and firearms may differ from state laws. As a general rule, federal laws will supercede conflicting state laws. Federal law may prohibit persons from possessing a weapon or a firearm even if they are not prohibited from possession by state laws.

Summary:

Once the statutes were researched, the categories were marked accordingly and the scores totaled up. The states and their respective requirements were then arranged in descending order from most strict law to least strict law.

Conclusion:

Proposition B is rated as the Most Strict for the Qualifications for Permit when compared to the provisions included in the other 30 states with right-to-carry concealed firearm laws.
